A trademark is a distinctive sign and often a company´s most valuable asset and competitive means. It is therefore important to protect and watch your trademarks. The easiest way to protect a trademark is to register it. Through the registration you get an exclusive right to commercial use of your trademark for the protected goods and services.
The most common trademarks are word marks or device marks but there are other possibilities such as slogans and 3D marks.
To be able to register a trademark it needs to be distinctive, i.e. through the trademark it should be possible to distinguish your product or service from those of others. This means that a trademark that is descriptive for the goods and services the trademark is intended for can not be registered. In some cases trademarks can become distinctive through use and this would overcome the obstacle. Furthermore a trademark must not be confusingly similar to trademarks previously applied for or registered by another nor to registered company names or family names (Swedish registrations).
