ATF (Alternativt Tvistelösningsförfarande) − Alternative dispute resolution procedure for .se

This alternative system of dispute resolution is applied to .se domains.

Three prerequisites
Three prerequisites are needed if you are to have any chance of winning a case.

• The applicant must have a right (e.g. trademark or trade name) that is valid in Sweden.
• The holder of the domain name must have acted in bad faith when registering or using the domain name.
• The holder must not have any right to or legitimate interest in the domain name.

An example of bad faith is if someone has registered a domain name with the aim of selling it, knowing that the designation constituting the domain name belongs to someone else. Another example of bad faith is registration of a domain name with the aim of disrupting a competitor’s business. Registering someone else’s trademark or family name is an example of not having a right to or a legitimate interest in the domain name.
